Father of three children, he was brutally killed with seven gunshots in front of his wife and children after a raid in Cassino in November 1943. Today, over 80 years later , compensation of 700 thousand euros has been ordered for the three children for war damage . This was decided in recent days by the Court of Rome which accepted the appeal presented by the heirs of the man, who lived in a small town on the Gustav line, between the Valle dei Santi and the Cassinate. For the judges it was a “war crime and crime against humanity” and they awarded the children compensation for damages which they quantified at around 700,000 euros. As the local edition of Il Messaggero writes, this is the first sentence of its kind in Italy.

What happened

The story dates back to November 1943. Italy was in the middle of the world war. About two months had passed since the armistice of September 8th. The Germans had settled in the Cassino area: they had food and drinks delivered to them by citizens. And they often did roundups. Precisely on one of these occasions the man fled into the countryside, into the woods, to hide . He returned home only in the evening. And it was at that moment that the German soldiers found him and took him from the house, killing him with seven gunshots in front of his wife and young children .

Compensation

The compensation was quantified by the judges at approximately 700 thousand euros . The payment comes from the special fund established by the Draghi government specifically for Nazi crimes committed on Italian soil between 1 September 1943 and 8 May 1945, continuity of the agreements between Italy and Germany. For 2023, 20 million have been invested in the fund, while from 2024 to 2026, 13,655,467 have been allocated for each year.

The reaction to the sentence

“A great result, obtained by presenting precise documentation. The man was killed in a barbaric manner. Now a line of applicants for war damages is opening up. My firm has already started around thirty cases “, declared the lawyer Sergio Messore , also mayor of the municipality of Sant'Ambrogio sul Garigliano. “Great satisfaction that it was recognized as a war crime – added the victim's children – Our mother died without receiving justice, but she always reminded us of this episode. We had been waiting for this moral recognition for 80 years .”
