In order not to transform the trial and the accused into “victims of the affair”, it is “necessary to guarantee the peaceful conduct of criminal proceedings in all its phases”. The Milan Council of the ANM (National Association of Magistrates) writes this in a note in reference to the strike of criminal lawyers promoted by the Criminal Chamber and scheduled for next March 4, the day of the new hearing of the trial in which Alessia Pifferi is being investigated for murder of his 18 month old daughter.
In addition to the accused, in a parallel investigation opened by the prosecutor Francesco De Tommasi (already in charge of the Pifferi case with his colleague Rosaria Stagnaro, now resigning in protest) for aiding and abetting and false ideology , the two psychologists from San Vittore and defense lawyer Alessia Pontenani. “An attack on the trial”, the president of the Board of Directors of the Criminal Chamber of Milan Valentina Alberta defined it in an interview with Fanpage.it.
For the occasion, the National Association of Milanese Magistrates also reiterated “the centrality, for the entire judiciary, of the value of the defensive function, in compliance with the provisions of articles 24 and 27 of the Constitution, which every magistrate must commit to on a daily basis , loyally, to implement”.
A colleague of the psychologists investigated for the case of Alessia Pifferi: “No one manipulated her”
But not only. ” Ascertaining the truth is in fact the objective of every investigation and every trial”, continues the note. “This can only happen, however, in an environment free of conditioning , which allows the trial to take place in a relaxed and peaceful manner , without anyone interfering, precisely to guarantee the balance of decisions and the full explication of the right of defence”.
Finally, the ANM of the Lombardy capital underlined that “the presumption of innocence and the equality of the parties in the trial are principles with which all legal practitioners have the duty to conform their activities. At the same time, if on the one hand the the work of the Prosecutor's Office must be kept distinct from the assessments of the individual magistrate within the proceedings, on the other hand it must be reiterated that only a serene judicial environment, free from external influences and disturbances, is able to guarantee the effectiveness of the principles mentioned above and the balance of the decisions of the judges and office managers”.
